MID Group Expedited Inc.
1. Determination of Charges
The Customer is responsible for all charges related to shipments, including transportation, fuel surcharges, accessorial charges, detention, layover, TONU (Truck Ordered Not Used), carrier fees, duties, customs, penalties, and taxes.
MID Group Expedited Inc. reserves the right to adjust or re-invoice charges if:
(i) incorrect or incomplete information is provided;
(ii) additional services are required; or
(iii) services differ from those listed on the Bill of Lading (BOL).
All invoice disputes must be submitted in writing within fifteen (15) days of the invoice date.
2. FMCSA & DOT Compliance
MID Group Expedited Inc. operates in compliance with applicable regulations of the Federal Motor Carrier Safety Administration (FMCSA) and the U.S. Department of Transportation (DOT).
Nothing in these Terms shall be interpreted to waive or limit any rights, responsibilities, or obligations required under applicable federal transportation laws and regulations, including but not limited to 49 CFR Parts 370–379.
3. Service Disclaimer
All transportation and dispatch services are provided on a best-effort basis. Transit times are not guaranteed and may be affected by weather, traffic, mechanical issues, shipper/receiver delays, or other factors beyond our control.
We are not responsible for:
- Delivery delays
- Missed appointments
- Consignee penalties or fines
4. Dispatch Services Disclaimer
If dispatch services are provided, MID Group Expedited Inc. acts solely as an independent dispatcher or intermediary. We do not guarantee specific rates, load availability, or revenue.
The owner-operator/carrier remains fully responsible for:
- Compliance with FMCSA/DOT regulations
- Insurance coverage
- Safe operation of equipment
5. Limitation of Liability
To the fullest extent permitted under Indiana law, MID Group Expedited Inc. shall not be liable for indirect, incidental, or consequential damages.
Total liability shall not exceed the amount paid for the specific service.
6. Insurance & Cargo Responsibility
Unless otherwise agreed in writing, MID Group Expedited Inc. does not assume liability for cargo loss or damage. Responsibility for cargo claims remains with the motor carrier as defined under applicable law.
7. Website Use
By using this website, you agree to comply with all applicable laws and these Terms.
8. SMS Communications
By providing your phone number, you consent to receive SMS messages. Mid Group Expedited Inc uses SMS messaging for business communication with customers, including dispatch updates, load confirmations, delivery notifications, and general customer support. Messages are only sent to customers who have provided prior consent through direct communication, service agreements, or business interactions. No unsolicited messages are sent.
Message frequency varies based on customer interaction and services requested. Message and data rates may apply. Customers can reply STOP at any time to opt out or HELP for assistance.
9. Indemnification
You agree to indemnify and hold harmless MID Group Expedited Inc. from any claims arising from your use of services or violation of these Terms.
10. Governing Law
These Terms are governed by the laws of the State of Indiana.
11. Changes to Terms
We reserve the right to update these Terms at any time.
